On June 25, 2024, the U.S. Department of Commerce issued an announcement to make a positive preliminary anti-subsidy ruling on certain paper plates imported from China and Vietnam. The preliminary ruling:
(1) Chinese enterprises:
Fuzhou Hengli Paper Co., Ltd.’s tax rate is 11.53%;
The tax rate of Jinhua P&P Product Co., Ltd. is 3.54%;
Ningbo Artcool Co., Ltd.; Ningbo Fenghua Yongfa Printing Stationery Co., Ltd.; Zhejiang Kingsun Eco -Pack Co., Ltd.); Zhejiang Lingrong Crafts Co., Ltd. was subject to a punitive tax rate of 313.14% because it failed to cooperate in responding to the lawsuit;
The tax rate for other manufacturers/exporters is 10.64%.
(2) Vietnamese enterprises:
Go-Pak Paper Products Vietnam Co., Ltd. tax rate is 5.48%;
A punitive tax rate of 237.65% was applied to Innovative Sonic Vietnam International, Ningbo Changya Plastic Vietnam Company, Ningbo Changya Plastic Vietnam, SCG Vietnam and Xie Li Vietnam International Company Limited for failing to cooperate in responding to the lawsuit;
The tax rate for other manufacturers/exporters is 5.48%.
The U.S. Department of Commerce is expected to make a final countervailing ruling on November 5, 2024. This case involves products under US Customs Code 4823.69.0040.
